Update on SB 3 Litigation

On September 26, 2025, a coalition of school districts, fire protection districts, and individual taxpayers filed suit challenging Section 137.1055, RSMo, enacted through Senate Bill 3. As part of the litigation, Plaintiffs filed a Motion for Summary Judgment seeking a ruling on the merits of the case.

Since the case was filed, thirty-one counties have intervened. The intervening counties filed a Motion for Preliminary Injunction seeking to prevent the proposed homestead property tax ballot language from appearing on the April 2026 ballot while the constitutionality of Senate Bill 3 is litigated. Judge Limbaugh heard oral argument on the Intervenors’ Motion for Preliminary Injunction on January 21st. The Court also recently heard argument on Plaintiffs’ Motion for Summary Judgment.

Judge Limbaugh has indicated that he intends to issue rulings on both the motion for preliminary injunction and the motion for summary judgment as expeditiously as possible, given the upcoming April election.
